Just a thought: Apple promotes iPhone with an OS which is a subset of Mac OS X. Why then is Apple allowed sell the iPhone WITH Safari, and why does nobody makes a big deal out of it? While Microsoft has to change their OS for these European laws!
With Windows you are allowed to install another browser, you aren’t even allowed to do this with the iPhone?

The reason why Apple (aside from it not having the biggest monopoly in the known universe) won’t ever get attacked is because EVERYTHING is EASILY removable, just like it was possible in Windows a decade ago (!!!). IE and its engine were both 100% removable back then. The “omg all the old shit we have needs Trident”-problem everyone seems to be jabbering about is easily solvable by packaging and supplying Trident as an installable browser engine (like xulrunner).
Removing IE BY DEFAULT is really silly imho, just like removing Safari from a default OS X install. Really the only thing Microsoft has to do to please the EC is separating Trident from the rest of Windows (like it was a decade ago) and make both Trident and IE options (radio boxes) while installing Windows (defaulting to the checked-state). Removing them afterwards shouldn’t be a problem of course.
